ORDER

The complainant being aggrieved by the delay in completing the investigation in connection with theft of jewels in his shop is before this Court seeking direction to complete the investigation and file final report in Crime No.76 of 2023 dated 30.03.2023.

2. The learned Government Advocate (Crl.Side) appearing for the State, on instructions, states that the accused in this case was arrested in a connected similar offence and he is in prison. Investigation is on but no recovery could be done. Hence, there is delay in filing the final report.

3. Recovery of stolen jewels and production before the Court is not a prerequisite for completion of investigation. Moreso, when the accused person has been already secured and detained in prison. The Investigation Officer in this case cannot delay in filing report unduly. Hence, he is directed to expedite the trial and file a final report within a period of four months.
