This petition is filed to condone the delay of 57 days in filing the writ appeal.
Heard Mr.S.Mohan, learned counsel for the petitioner, who would submit that in the address where notice has been served on the respondent since has been returned as he has left, whereas, from the same address, the respondent has filed contempt petition against the petitioner. Therefore, according to the petitioner, the respondent is avoiding the notice, to be served on him.
Recording the aforesaid submission and being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 57 days in filing the writ appeal stands condoned.
