The petitioner/A1 who was arrested and remanded to judicial custody on 11.09.2023 for the offences registered under Sections 417, 353(A), 376 of IPC, in Crime No.22 of 2023, seeks bail. 2.It is stated that the petitioner and the defacto complainant are also relatives and they had been in relationship and the petitioner had promised to marry her.
3.Sofar as the offence under Section 353A of IPC is concerned, the statement under Section 164 Cr.P.C recorded from the victim reveals that the petitioner had also taken photographs and videos during the video call, after asking her to put herself in a comprehensive position. 4.The statement is quite revealing and further investigation will have to be done on all these aspects.
5.At this stage, this Court is not inclined to grant bail to the petitioner.
