Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to pass orders for revising the consolidated pay salary payable to the petitioners as Guest Lecturers in Government Arts & Science and Education Colleges at least from the academic session 2024-25 in accordance with the proposal submitted by the second respondent in Na.Ka.No.31246/D2/2019 dated 29.03.2023 as Rs.30,000/- per month, in consideration of representation submitted by the petitioners, within a time frame to be fixed by this Court.

O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing respondents by revising the consolidated salary payable to the petitioners, who are working as Guest Lecturers in the Government Arts and Science Colleges from the academic session 20242025 in accordance with the proposal that has already been submitted by second respondent dated 29.03.2023 and thereby, enhance the consolidated pay to Rs.30,000/- p.m.

2. Heard Mr.G.Sankaran, learned Senior Counsel appearing for petitioners and Mr.K.Surendran, learned Additional Government Pleader appearing for respondents.

3. The case of the petitioners is that they possess all the qualification for appointment to the post of Assistant Professor. Initially, they were engaged as Guest Lecturers and paid consolidated pay of Rs.10,000/- and this was revised to Rs.20,000/- from the year 2021.

4. Repeated representations were made in this regard to revise the consolidated pay of Rs.30,000/-. In view of the same, the first respondent, through Government letter dated 21.04.2022, called for necessary proposal for revision of the consolidated pay which is payable to the Guest Lecturers working in Government Arts and Science Colleges. The second respondent, through proceedings dated 29.03.2023, forwarded the proposal to the first respondent. The Government, thereafter, issued orders in G.O.(D) No.261, dated 02.09.2023 and revised the consolidated pay to Rs.25,000/- p.m. with effect from June 2023.

The grievance of the petitioner is that they are entitled for consolidated pay of Rs.30,000/- p.m., whereas, the first respondent has revised the consolidated pay as Rs.25,000/- p.m. Hence, a representation dated 27.08.2024 was given by the petitioners in this regard. Since the same was not considered, the present writ petition has been filed.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the first respondent to deal with the representation made by the petitioners on 27.08.2024 on its own merits and in accordance with law and in line with the proposal submitted by the second respondent dated 29.03.2023 and take a final decision within a period of eight (8) weeks from the date of receipt of a copy of this order.

7. The petitioners are directed to submit a fresh representation to the first respondent along with all relevant documents and also a copy of this order. A copy of the representation shall also be marked to the second respondent.

This writ petition is disposed of with the above direction. No costs.
