ORDER
This writ petition has been filed challenging the letter dated 11.03.2005, issued by the first respondent thereby instructing the Land Acquisition Officers to follow the method of appropriating the amount of enhanced compensation deposited in the Court on the lines of the judgment passed by the Hon'ble Supreme Court of India in the case of Prem N. Kapoor & anr Vs. National Fetilizer Corporation of India Limited & ors.

Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.
The letter was issued on 11.03.2005. But the Writ Petition has been filed only in the year 2019 challenging the letter dated 11.03.2005 thereby issued instructions in respect of the enhancement of the compensation, as per the order passed by the Hon'ble Supreme Court of India that the amount deposited it to be first adjusted towards the amount due towards the market value (i.e., land value) solatium and then towards the amount payable under Section 23(1A) (ie., additional market
value) of the Land Acquisition Act, 1894 and thereafter the interest payable under Section 28 of the Land Acquisition Act. The Further principle laid down is once the amount is paid or deposited in Court, the interest will stop running. Accordingly, all the Land Acquisition Officers are instructed to follow the method of appropriating the amount of enhanced compensation deposited in the Court. 4.
On perusal of the counter filed by the first respondent, it is revealed that the prayer of the petitioner is to adjust the amount deposited in the Court while arriving the balance amount payable by appropriating the amount deposited in the Court first towards interest and then towards the solatium and finally towards land value as per the instructions given by the Government of India. Accordingly, the enhanced compensation amount, for the land owned by the petitioner, a sum of Rs.83,60,547/- (40%) was deposited in the Court. It is less than the interest payable in this case ie., Rs.3,37,689 + 2,68,860 + 1,23,03,864 = Rs.1,29,10,413/-. The balance enhanced compensation amount of Rs.1,01,96,935/- has been deposited in the Principal Subordinate Court, Tiruvannamalai, on 31.12.2019 as per the G.O.Ms.No.462 Revenue (RA1(2)) Department dated 27.11.2019.

Considering the above facts and circumstances, the prayer sought for in this Writ Petition cannot be granted and the Writ Petition is itself devoid of merits and is liable to be dismissed. Accordingly, the Writ Petition stands dismissed. Consequently, connected miscellaneous petitions are closed.
