This petition is filed to condone the delay of 435 days in filing the above criminal revision. Against the dismissal of petition under Section 156(3) Cr.P.C., the present revision has been preferred by the petitioner. 2.Mr.S.Sugendran, learned Additional Public Prosecutor takes notice for the second respondent police.

3.Mr.John Joseph, learned counsel takes notice for the first respondent and submits that copies have not been served to him. Learned counsel for petitioner is directed to serve the same to the respondent. 4.Learned Additional Public Prosecutor has got no serious objection in allowing this petition. The first respondent/private respondent has also got no serious objection. Both sides represented that main case itself can be taken up for final hearing.

5.In view of the above, the delay stands condoned and the petition is ordered.
