Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus to direct respondents 3 and 4 to re-survey the petitioner's lands in S.No.133/5A2, Sooradimangalam Village, Tirukazhukundram- TK, Chengalpattu District and fix four boundaries for the same.

O R D E R

The Writ Petition seeks mandamus to direct the respondents 3 and 4 to re-survey the petitioner's lands in S.No.133/5A2, Sooradimangalam Village, Tirukazhukundram- TK, Chengalpattu District.

2. The petitioner purchased punja lands measuring 0.33 cents in 2/7

in S.No.133/5A2, Sooradimangalam Village, Tirukazhukundram- TK, Chengalpattu District. On 19.02.2024, one Kathirvel, neighbour of the petitioner's land taking advantage of the petitioner living 11 Kms away from the said property, trespassed into the same. Therefore, on 17.10.2023, the petitioner made a representation to the District Survey Office, Chengalpattu, along with the fees, for surveying his land. Thereafter, the petitioner has made several representations in this regard. However, the same was not considered. Therefore, the petitioner is before this Court.

3. Heard the learned counsels on the either side and perused the records.

4. Considering the facts and circumstances of the case, mandamus is issued to the respondents 3 and 4 to conduct re-survey of the petition mentioned property. The petitioner shall submit all the relevant records to show his title to the property and the respondents 3/7

shall, after issuing notice to the adjacent land owners and interested parties, hold an enquiry and thereafter, proceed to pass orders either surveying and subdividing the property or rejecting the request. In the case of a rejection, a speaking order shall be passed. The aforesaid exercise shall be completed within a period of 2 weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is allowed. No costs.
