J U D G M E N T
[Judgment was delivered by S.M.Subramaniam J.] The writ order dated 28.07.2022 in WP.No.4605 of 2019 is under challenge in the present writ appeal. Writ petitioners are the appellants before this Court.
2. The writ petition was closed by the learned Single Judge on the ground that the land acquisition proceedings were withdrawn by the Government on 12.11.2006 itself in G.O.Ms.No.7, Housing and Urban Development Department dated 03.01.2007.
3. When the writ appeal is taken up for hearing, the learned Senior Counsel, Mr.R.Singaravelan, appearing on behalf of the appellants would submit that the cause did not exist and therefore, the appellants may be permitted to withdraw the writ appeal.
4. Per contra, the learned Standing Counsel appearing on behalf of the Housing Board would submit that acquisition proceedings completed in all respects and the lands acquired were handed over to the Housing Board for Page No.2 of 5
developing housing scheme.
5. Thus, withdrawal of the writ appeal would not cause prejudice to the interest of the appellants. Thus, the appellants are permitted to withdraw the present writ appeal.
6. Accordingly, the Writ Appeal stands dismissed as withdrawn. No costs. Consequently, the connected Miscellaneous Petition is closed.
