The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(1) of Solvent Raffinate and Slop (Acquisition, Sale, Storage and Prevention of Use in Automobiles) Order, 2000 and 7(1)(a)(ii) of Essential Commodities Act, 1955 in Crime No.174 of 2023 seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is the owner of the godown, where 8000 litres of Industrial Oil was seized. The defacto complainant, who is the Deputy Superintendent of Police had lodged a complaint on 21.08.2023 and FIR had been registered by him. Hence, this case.

3. The learned Government Advocate (Criminal Side) stated that A3 and A4 were the drivers of the lorries bearing registration Nos. TN 05 CL 9558 and TN 03 AD 0147. He also stated that they had been arrested and granted bail.

4. The learned counsel for the petitioner stated that the petitioner had rented out his property to one M.Sakthivel, who is the owner of M/s.Sai Enterprises and he also produced the copies of that rental agreement. He further

stated that the petitioner is an innocent person and he has been falsely implicated in this case.

5. But however, the Industrial Oil was seized from the place of the petitioner, who is the owner of the same. In view of that particular fact, I am not inclined to grant anticipatory bail to the petitioner herein. This Criminal Original Petition stands dismissed.
