PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India, to issue Writ of Mandamus to direct the 2nd respondent and its subordinates to forbear from interfering with the civil dispute and civil rights over the properties which are pending adjudication between petitioners and the 3rd respondent in a civil suit in O.S. No.287/2023 before the Additional District Judge, Udumelpet at the instance of the 3rd respondent and any other person claiming through her.

ORDER

On the receipt of the complaint registered in CSR.No.677 of 2023, the Police has called the petitioners herein for enquiry and after enquiry, they have found that it is a civil dispute and suit is already been initiated and pending. The parties were advised to workout their remedy before the competent Civil Court and CSR was closed on 27.10.2023. While so, the petitioner herein filed a petition seeking direction from this Court forbearing the 3rd respondent from enquiring the complaint.

2. The said allegation and averment as well as the prayer sought does not survive in view of the closure of CSR No.677 of 2023 dated 27.10.2023. Hence, this petition is dismissed. Consequently, connected Miscellaneous Petition is also dismissed.
