ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in C.C.No.2 of 2018 was taken on the file of the Judicial Magistrate, Sathyamangalam Taluk, Erode for the alleged offence under Section 379 of I.P.C. The occurrence is of the year 2017. The allegation in this case is that the accused has stolen the lorry of the de-fact complainant. The property involved in this case has been recovered and handed over to the defacto complainant. It is reported that the accused has been attending the Court regularly. It is stated that the de-facto complainant has no objection for closing the case. There is no previous or subsequent previous case against the accused. D.BHARATHA CHAKRAVARTHY, J.

Suo Motu TR.No.6725 of 2025 3.Considering the nature of the allegation, the antecedents of the accused and since the accused has been facing the case since 2017, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served. 4.Accordingly, the case in C.C.No.2 of 2018 of Judicial Magistrate Sathyamangalam Taluk, Erode, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
