ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.
2. The case was registered in Cr.No.158 of 2018 dated 15.10.2018 for the alleged offence under Section 379 of Indian Penal Code, 1860. The stolen property has been recovered and handed over to the defacto complainant. There are no other previous or subsequent cases pending against the accused. NBW is pending. The defacto complainant is willing to contest the case further.
3.However, considering the fact that the case is of the year 2018 and the Page No.1 of 3
accused remains elusive and is said to be native of Jharkhand State, this is a fit case for invoking the extraordinary powers under Article 226 of the constitution of India to close the case with liberty to the prosecution to reopen it if the accused resurfaces or any clue regarding the accused is obtained in future.
4. Accordingly, the case in C.C.No.143 of 2019 on the file of the Judicial Magistrate Court No.II, Poonamallee Taluk, Tiruvallur, shall stand closed and this Suo Motu Transfer Case stand disposed of. 07.10.2025 sms electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
