PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to consider the application dated 30.01.2024 submitted by the petitioner to the 2nd respondent seeking compassionate appointment, followed by further representation of the petitioner dated 28.05.2024.

ORDER

This writ petition has been filed to consider the application dated 30.01.2024 submitted by the petitioner to the 2nd respondent seeking compassionate appointment, followed by further representation of the petitioner dated 28.05.2024.

2. The case of the petitioner is that the petitioner's mother was employed in the respondent Board as a Sweeper. She died on 12.06.2023 while in service. The petitioner's elder brother and his two sisters are married and living separately. The petitioner is dependent on his mother. Therefore, he submitted a representation dated 30.01.2024 to the 2nd respondent to provide employment on compassionate basis. Thereafter, the 2nd respondent sent a communication dated 09.05.2024 that the petitioner did not enclose his educational proof and birth certificate. Therefore, on 28.05.2024, the petitioner sent his letter dated 28.05.2024 along with his educational proofs and birth certificate, but the same has not been considered by the respondent authorities. Hence, the present writ petition.

3. Learned counsel appearing for the respondents would submit that the representation of the petitioner will be considered by the Page No:2/4

respondents on its own merits and in accordance with law, within the time fixed by this Court.

4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to direct the 2nd respondent to consider the representations of the petitioner dated 30.01.2024 and 28.05.2024 and pass final orders on its own merits and in accordance with law, within a period of twelve weeks from the date of receipt of copy of this order.

5. With the above direction, the Writ Petition stands disposed of. No costs.
