O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 126(2), 296(b), 115(2), of BNS Act, and under Section 341, 294(b), 323 of IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 1998, in Crime No. 1/6

429 of 2025, on the file of the respondent Police, seek anticipatory bail.

The allegation against the petitioner is that on 10.08.2025 at about 11.30 am, when the daughter of the de-facto complainant who is aged about 16 years coming from a school, the petitioner waylaid her, had abused filthy language and assaulted on her cheek, chest, hand, stomach and leg in a public place. Later, she was admitted to the Rajiv Gandhi Hospital, Chennai, for further treatment. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is noway connected with the alleged offence. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the victim was assaulted by the accused and she was sustained injuries in all over her 2/6

body and rushed to the Rajiv Gandhi Hospital. He further submits that investigating is on. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the gravity of the offence was committed by the petitioner and the nature of allegations against the petitioner, and the fact that the investigation in this case is yet to be concluded, this Court is not inclined to grant bail to the petitioner.
