ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.

The case was registered in Cr.No.482 of 2019 dated 12.07.2019 for the offence under section 4(1)(a) of TN Prohibition Act. The allegation in this case is that on 12.07.2019, the accused was found to be possession of 10 bottles of liquor containing 180 ml each, which is less than 4.5 litres limit set by the Government. It appears that the quantity is within the permissible limit for personal consumption. The summons was not served, consequently warrant pending. There is no previous or subsequent case against the accused. Considering the factual matrix and context, any further continuance of the proceedings will impinge upon the accused's right to a speedy trial. Accordingly, the proceedings in STC.73/2024 on the file of the District Munsif -Cum- Judicial Magistrate Court, Thiruvennainallur, Thiruvennainallur Taluk, Villupuram is quashed and this Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
