This application has been filed by the defendants seeking to condone the delay of 90 days in filing the list of documents in C.S.(comm.Div.)No.40 of 2023.

2. The applicants/defendants have also filed written statement in the main suit. But, according to the applicants, inadvertently, the documents in support of the pleadings in the written statement have not been filed. Only under those circumstances, an application has been filed seeking leave of this Court for reception of additional documents. However, the said application is yet to be numbered. The present application has been filed seeking to condone the delay of 90 days in filing the list of documents in C.S.(comm.Div.)No.40 of 2023. Only after this application is allowed, the other application filed by the applicants seeking leave of the Court for reception of additional documents will get numbered.

3. This Court is also satisfied with the reasons contained in the affidavit filed in support of this application, as sufficient cause has been shown. The learned counsel for the respondent/plaintiff has stated no objection for allowing this application. Accordingly, this application is allowed as prayed for.

4. Registry is directed to number the application filed by the applicants/defendants seeking for reception of additional documents, if it is otherwise in order.

5. The learned counsel for the plaintiff would submit that if the defendants restrict to the usage of the mark 'Elite Marriage Bureau' alone without insisting for the usage of 'Elite Matrimony', there is a possibility of amicable settlement between the parties. The learned counsel for the defendants seeks time to get instructions with regard to the same. Post the matter on 05.01.2024.
