2 RAFI AHAMED Petition praying that in the circumstances stated therein the High Court will be pleased to grant Extension of time to the petitioner to deposit of the 2nd instalment of Rs.6,25,000/- incompliance with the conditions imposed by this Hon`ble court in the order dated 06/09/2019 passed in Crl.MP.No.12799/2019 in Crl.RC.No. 872/2019.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.N.BAASKARAN, Advocate for the petitioner and of MR. M.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR(R-1) on behalf of the Respondent the court made the following order:- The criminal miscellaneous petition has been filed by the petitioner/Accused, seeking to grant extension of time to the petitioner to deposit the 2nd instalment of Rs.6,25,000/- in compliance with the conditions imposed in the order passed by this Court, in Crl.M.P.No.12799 of 2019 in Crl.R.C.No.872 of 2019, dated 06.09.2019.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the 1st respondent. The learned counsel for the petitioner would submit that this Court, had directed the petitioner to deposit 50% of the cheque amount viz., Rs.12,50,000/- before the Trial Court in two instalments, viz., the 1st instalment to be paid within four weeks from the date of receipt of a copy of that order and the balance amount of Rs.6,25,000/- to be paid within four weeks of the payment of the 1st instalment and would submit that the petitioner has complied with the order by depositing the 1st instalment of Rs.6,25,000/- however, due to certain financial constraints, he is https://hcservices.ecourts.gov.in/hcservices/

unable to deposit the balance amount of Rs.6,25,000/- and thereby, he has filed a petition seeking for extension of time by two weeks. Taking into consideration and the said submission, time is extended by further period of two weeks from today.
