This petition has been filed to transfer the investigation in Crime No.208 of 2019 pending from the file of the first respondent police to third respondent police and investigate the same.
2. The learned counsel for the petitioner submitted that one of the accused has not been impleaded in Cr.No. 208 of 2019 and he also represented before the Deputy Commissioner of Police. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Additional Public Prosecutor submitted that the entire investigation has been completed and after getting approval of the learned Additional Public Prosecutor, the final report has been laid before the learned XVIII Metropolitan Magistrate, Saidapet, Chennai. It was returned for the reason of pandemic circumstances of Covid-19.
4. Considering the submission made by the learned Additional Public Prosecutor, the transfer of investigation does not arise since already investigation has been completed. Therefore, this Criminal Original Petition is dismissed. However, the learned XVIII Metropolitan Magistrate, Saidapet, Chennai is directed to take the final report on presentation of the charge sheet. However, the petitioner is at liberty to invoke the provision of 216 & 319 Cr.P.C., before the trial Court during the trial.
