C.M.P.No.21620 of 2022 in C.M.A.SR.No.79553 of 2022 SUNDER MOHAN,J.

This Petition has been filed seeking to condone the delay of 15 days in filing the above Civil Miscellaneous Appeal.

2. Learned counsel appearing for the petitioner would submit that the 2nd respondent remained ex-parte before the Tribunal and notice to R2 has been dispensed with vide order of this Court dated 30.08.2023.

3. Though paper publication has been effected in respect of 1st respondent and notice was served on the 3rd respondent on 12.01.2023 and their names having been printed in the cause list, none entered appearance on behalf of them.

4. Heard the learned counsel for the petitioner/appellant.

5. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned. Hence, this petition is ordered as prayed for.

6. Registry is directed to number the C.M.A., if it is otherwise in order and list the same in due course.
