ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.141 of 2021 dated 24.04.2021 for the alleged offence under Section 379 of Indian Penal Code, 1860. The occurrence in this case happened on 18.04.2021. The complainant is present and submits that his two wheeler bearing Registration No. TN-78-Q-1414 has Page No.1 of 3

been returned to him. The accused remains untraceable and fresh summons could not be executed from 2019 despite best efforts. The complainant does not wish to pursue the case any further.

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in CC.No.27/2022 on the file of the Judicial Magistrate Court No-II, Udumalpet, Udumalpet Taluk, Tiruppur shall stands quashed and this Suo Motu Transfer Case stands disposed of. 22.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
