O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 296(b), 351(3) of BNS r/w 4 of Tamil Nadu Prohibition of Harassment of Women Act, in Crime No.Not known of 2025, on the file of the respondent Police, seeks anticipatory bail. 1/4

2. The allegation against the petitioner is that the petitioner had an love affair with the defacto complainant's daughter and the same was questioned by the defacto complainant there was quarrel arose between them. Due to which, the petitioner threatened the defacto complainant with dire consequences. Hence, the case has been registered.

3. The learned counsel for the petitioner submits that the petitioner is innocent and he has not committed any such offence as alleged by the defacto complainant and he has been falsely implicated in this case. He also submits that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submitted that the petitioner is having a habit of stalking and harassing the victim girl aged about 12 years and the petitioner's aged is about 20 years and having two previous cases which includes under Section 302 of IPC. Hence, he opposed to grant anticipatory bail to the petitioner. 2/4

5. Considering the above facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Criminal Side), and also considering the nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 17.09.2025 ssi To 1.The Judicial Magistrate (Additional Mahila Court), Vellore.
