ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.138 of 2021 dated 19.04.2021 for the alleged offence under Section 379 of Indian Penal Code, 1860. The occurrence in this case happened on 06.04.2021. The complainant is present and submits that his two wheeler bearing Registration No. TN-42 AE-9255 has been returned to him. The accused is regularly appearing before the Court and Page No.1 of 3

the accused has no previous or subsequent case. The complainant does not wish to pursue the case any further.

3. Considering the long pendency, the complainant's stand and further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in CC.No.55/2021 on the file of the Judicial Magistrate Court No-II, Udumalpet, Udumalpet Taluk, Tiruppur shall stands quashed and this Suo Motu Transfer Case stands disposed of. 22.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.2 of 3
