ORDER

This writ petition is filed to quash the order of the 2nd respondent in proceedings No.3/24243/ 2019 dated 05.12.2022 and to consequently direct the respondents to permit the petitioner to continue as a cook in the Government Backward class boys Hostel, Ponnai.

2.Heard learned counsel for the petitioner and learned Special Government Pleader appearing on behalf of the respondent and also perused the available records.

3.Learned counsel for the petitioners submits that the issue involved in the present writ petition is squarely covered by the decision of this Court dated 18.07.2024 in W.P. No. 14681 of 2022 etc. (Batch), whereby this Court quashed the proceedings dated 12.05.2022 issued by the 3rd respondent therein. He further submits that the petitioners in the present writ petition are also assailing the same proceedings dated 12.05.2022, as well as the consequential order dated 05.12.2022.

4.It is contended that, the petitioner is entitled to the same relief as granted by this Court in the aforementioned batch of writ petitions.

5.The learned counsel appearing for the respondents, on instructions, fairly conceded that the order passed by the Coordinate Bench of this Court squarely covers the issue involved herein.

6.In view of the submissions made by the learned counsel on either side, this Court is of the view that the impugned order dated 12.05.2022 and the consequential order dated 05.12.2022 cannot be sustained and are, therefore, liable to be quashed 7.Accordingly, the Writ Petition is allowed, and the impugned proceedings dated 12.05.2022, along with the consequential proceedings dated 05.12.2022, are hereby quashed, in terms of the reasons recorded in the order dated 18.07.2024 passed in W.P. No. 14681 of 2022 etc. (Batch). No costs. Consequently, connected miscellaneous petition is closed. 06-02-2026 Index: Yes/No Speaking/Non-speaking order SHA
