This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 15.08.2024, seeking bail in Crime No.419 of 2024 for the alleged offences punishable under Section 275, 123 of BNS 2023 and 24(1), 6(b) of COTPA Act. 2.The case of the prosecution as per the Defacto Complainant is that on 10.10.2024 when the Respondent police on regular patrol duty, the Petitioner was found in possession of 513 packets of cool lip, 550 packets of HANS, 156 packets of Vimal, 200 packets of VI Tobacco. Hence the case. 3.Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4.Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there are eight previous cases pending against the petitioner. He further submitted that the total value of contrabands seized from the petitioner approximately comes to Rs.2,00,000/- hence, he opposed for granting bail to the petitioner. 5.Heard both sides and perused the materials available on record. 6.Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and considering the fact that there are eight previous cases, pending against the petitioner and considering the value of contrabands seized from the petitioner to the tune of Rs.2,00,000/-, this Court is not inclined to grant bail to the petitioner for the present.

7.Accordingly, the Criminal Original Petition stands dismissed for the present.
