The petitioner seeks bail in Crime No.1617 of 2021, registered by the respondent police for the offences punishable under Section 302 of IPC. The occurrence was on 20.12.2021.

2.The deceased is the wife of the petitioner herein. The petitioner had surfaced and was taken into custody on 08.07.2023. From the date of occurrence on 20.12.2021 till 08.07.2023, the petitioner had not contacted anybody about the missing of his own wife. The body was recovered after two days in the cupboard of the house. The conduct of the petitioner is extremely glaring.

3.It is stated by the learned counsel for the petitioner that the petitioner had been in contact with his son. But, even then he must have raised issues about the missing of his wife or death of the wife.

4.It is the case of the prosecution that after strangulating the deceased, he had put the body in the cupboard. The petitioner simply disappeared to Tiruvannamalai and Delhi and all other places and later, he had sent money to his son and on that basis, the respondent had traced him and he had been secured. Had he not been arrested he would still be absconding, which would only indicate that there is every possibility of the petitioner again absconding. There is also possibility of threatening the son before he deposes evidence.

5.It is stated that final report had been filed and the same had been taken cognizance as P.R.C.No.140 of 2023 by the X Metropolitan Magistrate, Egmore, Chennai. Let the trial continue. At this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
