This petition has been filed to modify the condition 6(iv) imposed upon the petitioner by this Court in Crl.M.P.No.6075 of 2020 in Crl.A.No.395 of 2020 dated 07.10.2020.

2. Learned counsel for the petitioner submitted that this Court, while suspending the sentence imposed on the petitioner in C.C.No.3 of 2009 on the file of II Additionl District Judge (CBI Cases), Coimbatore, dated 23.09.2020, had directed the petitioner to appear before the trial court on the first working day of every month at 10.30a.m., until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C., and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court and the petitioner is complying with the condition regularly and seeks for modification of the abovesaid condition.

In view of the above, the condition 6(iv) of the order in Crl.M.P.No.6075 of 2020 in Crl.A.No.395 of 2020 dated 07.10.2020 alone is modified as follows:- "6(iv) The petitioner shall appear before the trial Court once in four months starting from 1st working day of January 2024 at 10.30a.m., until the disposal of the appeal."

5. It is made clear that the rest of the order shall remains unaltered.

6. With the above direction, this Criminal Miscellaneous Petition stands ordered.
