The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 420 IPC, in Crime No.29 of 2023, on the file of the respondent police seeks anticipatory bail. 2.The learned counsel for the petitioner states that the petitioner is an innocent person and he has been falsely implicated in this case. Thus, he prays for grant of anticipatory bail for the petitioner. 3.It is stated that all the accused had run a Diwali chit fund in the year 2020-21 promising to return back the amount with higher interest and promising to return back one gram of gold. In this manner, they collected Rs.76/-lakhs from 80 individuals and one gram gold each from 100 individuals separately.
4.The learned counsel for the petitioner states that the petitioner herein is only an employee under the first accused, who is running a charitable trust, namely, Annai Educational & Women Development Foundation. The 1/3
objects of the said foundation have not been presented before this Court. There is no evidence that it is a charitable trust. It is stated that the wife of the defacto complainant is a member of the said foundation. Be that as it may, the plight of the 180 depositors' money will have to be kept in mind. Therefore, I am not inclined to grant anticipatory bail to the petitioner herein. 5.Accordingly, this Criminal Original Petition stands dismissed. sli 15.11.2023 2/3
