The petitioner seeks anticipatory bail in Crime No.39 of 2023, registered under Sections 7 & 8 of the Protection of Child from Sexual Offences Act, 2012.

2.The learned counsel for the petitioner stated that the petitioner is a P.T. Teacher in a school. It is also stated that the family of the petitioner and the family of the defacto complainant have on going quarrel about chickens and the defacto complainant had killed six chickens with poison. It is also stated that for the alleged incident, petitioner's wife had given a complaint six months prior to the lodging of the present complaint. It is stated that this is a motive one.

3.On the other hand, the statement of the victim girl had been recorded under Section 164 (5) Cr.P.C. and had been presented before this Court. It is very clear that she has acknowledged that the petitioner herein is working as a P.T. teacher and also about the incident and also stated about the fact of her confiding the incident to her mother. https://www.mhc.tn.gov.in/judis 1/2

sli 4.All these facts require further investigation and the petition seeking anticipatory bail will not lie as the respondent will have to investigate whether this is the only incident or any other children are also affected by the acts of the petitioner. In view of these facts, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
