The petitioner herein seeks anticipatory bail in Crime No.629 of 2023 registered by the respondent Police for the offences under Sections 153, 352 and 506(ii) IPC.

2.The learned counsel for the petitioner stated that he has been falsely implicated as an accused in this case. Apprehending arrest from the respondent police, he seeks bail to the petitioner.

3.The learned Government Advocate (Criminal side) stated that, on 07.10.2023, the defacto complainant had lodged a complaint that he had viewed his facebook page and whatsapp page and found that the petitioner herein had been forwarding messages derogating the Hon'ble Chief Minister and other Ministers. The petitioner could have posted messages of other the issues which are agitating the minds of the public.

gd 4.The petitioner appears to have forwarded the messages which has now led him as accused under Section 153 IPC. Investigation will have to be done to find out the source of these messages. Investigation can never even commence. 5.Taking into consideration all the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
