O R D E R

This petition has been filed seeking directions to the respondent police not to harass the petitioner under the guise of enquiry. Heard the learned counsel on either side and perused the materials available on record.

It is the grievance of the petitioner that the petitioner appeared before the respondent police more than five times and thereby the petitioner and their family members were harassed by the respondent police by asking them to appear before the respondent.

According to learned Additional Public Prosecutor for the respondents 1 & 2, based on the complaint given by the defacto complainant, summons were issued on the petitioner for enquiry and there is no harassment. Whenever the respondent police receive complaint, it is the bounden duty of the respondent police to enquire into the matter and file report before the Magistrate. Therefore in view of the statement made by the learned 2/4

Additional Public Prosecutor for the respondent police and the reasons stated by the petitioner is also not satisfied, this Court is not inclined to grant the relief sought for in the petition.

Accordingly this criminal original petition stands dismissed. However, the petitioner is directed to co-operate with the respondent police to complete investigation.
