PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for the issuance of a writ of Mandamus directing the Central Administrative Tribunal, Chennai Bench, to dispose the Original Application in OA No.177 of 2023 dated 20.02.2023 filed by the petitioner as expeditiously as possible.

ORDER

(Order of the Court was made by D.KRISHNAKUMAR, J.) By consent of parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The writ petition has been filed with a prayer to dispose of the Original Application in OA No.177 of 2023 dated 20.02.2023 filed by the petitioner at the earliest.

3. According to the petitioner, on 25.06.1995, he was selected as Police Constable in the respondent Police Department. Thereafter, he was promoted as Head Constable. While he was working as Head Constable, the respondent Department issued a notification in the year 2004 inviting applications for the post of Sub Inspector by way of direct recruitment. The petitioner also participated. Since the petitioner was not selected due to mal practice, he made a complaint to the authorities about the same and the respondent authority suspended the petitioner from service on 16.11.2021 on the ground that petitioner had made a complaint. Aggrieved by the same, the petitioner had filed an Original Application before the Central Administrative Tribunal, Chenai in OA No.177 of 2023, for revocation of the suspension order. The said OA is still pending before the Central Administrative Tribunal and hence the petitioner has filed the present writ petition for the aforesaid prayer.

4. Mr.Syed Mustafa, learned Special Government Pleader, takes notice for respondents `1 to 4 and submits that counter affidavit will be filed by the respondents before the Tribunal within three weeks. 3/6

5. We do not wish to go into the merits of the case. However, considering the limited scope of the prayer, we direct the Central Administrative Tribunal, Chennai to dispose of OA No.177 of 2023, on merits, as expeditiously as possible, within a period of twelve weeks from the date of receipt of a copy of this order. There will be no order as to costs.
