ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. This case is registered for alleged offences under Sections 457 and 511 of IPC. It is stated that both the accused have attempted to commit theft from a School. A1 was in detention for about twenty eight days. It can be seen that already withdrawal proceedings was initiated. Be that as it may the occurrence is of the year 2000 and almost twenty five years have gone. This case cannot remain on the file of the Magistrate anymore.

3. Considering the nature of the allegation and the antecedants of the accused, further continuation of the trial would impinge upon the right to a speedy trial of the accused. Continuing with the case would serve no useful purpose.

4. Accordingly, CC.No.500032 of 2008 of Judicial Magistrate Court No.1, Dharmapuri Taluk, Dharmapuri stands quashed and this Suo Motu Transfer case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
