ORDER
The present Writ Petition is filed praying for issuance of a Writ of Certiorari, to quash the impugned proceedings in Ref. No.17950 /ESI /SC /1 / 2023 dated 15.09.2023 and the impugned Charge Memo dated 15.09.2023 in Ref. No.17950/ ESI/ SC/ 1/ 2023-I, issued by the second respondent herein.
2. Learned Government Advocate appearing for the respondents would submit that pursuant to the charge memo, an enquiry was conducted, in which petitioner had also participated. As a matter of fact, the enquiry report has also been furnished to the petitioner today. In view thereof, nothing further survives for adjudication in the present writ petition.
3. Learned counsel for petitioner, agreeing to the above submission, would submit that the entire disciplinary proceedings may be completed within the time frame fixed by this Court.
4. Learned Government Advocate for the respondents would submit that petitioner may submit his response to the enquiry report, and thereafter, the disciplinary proceedings would be completed within the time stipulated by this Court.
5. Recording the submissions made by the learned counsel on either side, this Court directs petitioner to submit his reply/response to the enquiry report within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents shall proceed to pass final orders in the disciplinary proceedings, on merits and in accordance with law, within a period of twelve (12) weeks thereafter.
