Respondent PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to set aside the Order passed in Crl.M.P.No.23842 of 2022 dated 05.12.2022 by learned Court of Session Chennai and modified the condition imposed that to direct the petitioner to appear before the learned XXIII Metropolitan Magistrate Court Saidapet instead of petitioner appear before the respondent police daily at 10.AM until further order in Crl.M.P.No.22728/2022 in Crime No.494/2022 pending on the file of the respondent.

ORDER

This petition has been filed challenging the order passed by the Court below refusing to modify the condition imposed by the Court below while granting anticipatory bail to the petitioner.

2. The learned Government Advocate (Crl.side) appearing on behalf of the respondent submitted that investigation has been completed and final report as been filed before XXIII Metropolitan Magistrate Court Saidapet and the same is yet to be taken on file.

3. In the light of the above development, the condition imposed by the Court below directing the petitioner to appear before the respondent police daily at 10.00 a.m., need not be imposed at this length of time on considering the fact that the investigation has been completed.

4. In view of the above, the order passed by the Court below in Crl.M.P.No.23842 of 2022 in Crl.M.P.No.22728 of 2022 dated 05.12.2022 is hereby set aside. The petitioner is directed to appear before the trial Court during the every date of hearing without fail. Pg.No.2 of 4

5. Accordingly, this Criminal Original Petition is disposed of in the above terms.
