PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to direct the respondent to produce the seized property of money of Rs.60,000/- before the concerned Magistrate Court and permit the petitioner to withdraw the same. O R D E R

This petition has been filed seeking a direction, to direct the respondent to produce the seized property of money of Rs.60,000/- before the concerned Magistrate Court and permit the petitioner to withdraw the same.

2. The learned counsel for the petitioner has submitted that based on the complaint given by the petitioner FIR was registered in Cr.No.227 of 2019 under Sections 379 and 420 of IPC on 25.08.2019 and on the same day, the accused was arrested and a sum of Rs.60,000/- was seized, but the said amount was not produced before the court till today.

3. The learned Additional Public Prosecutor appearing for the respondent has submitted that since the concerned Magistrate is on leave, the said amount was not produced before the concerned court.

4. Considering the aforesaid submission, the respondent is directed to produce the aforesaid amount before the concerned Magistrate within a week from the date of receipt of a copy of this order.

5. With the aforesaid directions, this petition is disposed of.
