ORDER
This Writ Petition is filed directing the respondents herein to consider the representation of the petitioner dated 19.09.2024 and 16.10.2024 and also to issue direction to the respondents to grant permission to stay in the quarters till the month of May 2025.
2. The petitioner entered the service as Constable Grade-1 under the Tamil Nadu Police Regiment on 01.12.2003 and in 2018, he was promoted as the Head Constable. On 20.07.2024, he got transferred to Manjoor Police Station in Nilgiris District. Accordingly, the petitioner joined his service at Manjoor Police Station.
3. It is the case of the petitioner that while he was posted at Coimbatore, he was residing with his family at the Police Quarters situate at Gandhipuram, Coimbatore in Door No.J10. The children of the petitioner are pursuing their graduation and 12th standard in Coimbatore and they are in crucial stages in their respective educational journeys. On account of transfer of the petitioner, vacating the police quarters and 2/8
relocating to another place may cause a significant distraction to his children who are on the verge of completing their respective courses. Therefore, outlining the genuine reasons, he made a representation seeking permission to continue to stay in the police quarters until May 2025 to the respondents on 19.09.2024 and 16.10.2024, but the same was not at all considered by the respondents till date, hence left with no other alternative, the petitioner has filed the present writ petition .
4. Learned counsel for the petitioner submitted that the children of the petitioner are pursuing graduation and 12th standard in their respective college and school. In the event of changing their residence, it would be difficult for the petitioner to change his children's institutions, since they are on the verge of completing their respective courses. Hence, he seeks extension of time for his family to stay in the same headquarters, till the completion of college semester and board exams.
5. Heard both sides and perused the materials available on record.
6. Considering the submissions of the learned counsel for the 3/8
petitioner, this court is of the opinion that the representation of the petitioner 16.10.2024 and 19.09.2024 seeking permission to stay in the Police Quarters has to be considered positively by the authorities namely Commissioner of Police, Coimbatore City. The respondents can collect the applicable rent which could be fixed by them for the petitioner's family staying in the head quarters till 30th May 2025. 7.With the above direction this Writ Petition is disposed of. No costs.
