O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 8(c) r/w 20(b)(ii) (B) and 29(1) of NDPS Act, in Crime No.219 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner is arrayed as A2. A1 and A2 are relatives. The respondent police was on regular checkup was found that A1 in this case illegally possessed 3.400 gms of ganja. Based on the confession of A1, this petitioner has been arrayed as an accused. Hence, the case.

The learned counsel for the petitioner submitted that based on the confession statement of A1, the petitioner has been falsely implicated in this case and he has not involved any offence as alleged by the defacto complainant. He also submits that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submitted that the petitioner and A1 in this case are relatives and A1 in this case illegally possessed 3.400 gms of ganja and based on the confession statement of A1, the petitioner has been arrayed as an accused No.2 in this case. However, he opposed to grant anticipatory bail to the petitioner. 2/4

5. Considering the above facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Criminal Side), and considering the quantity of contraband involved in this case, I am not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 17.09.2025 ssi To 1.The Judicial Magistrate No.II, Namakkal.
