The petitioner, who was arrested and remanded to judicial custody on 05.09.2023 for the offences under Sections 6, 5(j)(ii), 5(l) and 5(n) of POCSO Act, in Crime No.19 of 2023, seeks bail. 2.It is stated that the name of the petitioner has been found place in the first information report as well as the statement recorded from the victim girl under Section 164(5) of Cr.P.C. It is also stated that the victim child, aged 16 years has conceived.
3.There are totally three accused in this case. Naturally, the medical test will have to be done on each one of the accused and thereafter, DNA test will also has to be done. 4.All the steps will have to be taken and one of the accused is still absconding.
5.In view of that particular fact, this Court is not inclined to grant bail to the petitioner.
