The petitioner apprehends arrest by the respondent police in respect of the Non-Bailable warrant issued by the Judicial Magistrate No.IV, Tiruppur, in C.C. No.264 of 2021 in Crime No.10 of 2019 for the alleged offences under Sections 406, 408, 420, 120B, 109, 294(b) and 506(i) of IPC, seeks anticipatory bail.

When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would submit that the petitioner is arrayed as accused in this case and due to his non-appearance, the Trial Court has issued non-bailable warrant and the same is pending before the Trial Court and the petitioner is ready to surrender and hence he seeks anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police submits that the Trial Court has issued nonbailable warrant against the petitioner for his non-appearance and the same is pending in C.C.No.264 of 2021.

Considering the representations on both sides and considering that NBW is pending against the petitioner, it is appropriate to direct the petitioner to appear before the Trial Court where NBW is pending by filing an appropriate petition to cancel the non-bailable warrant. Accordingly, the petitioner is directed to appear before the Trial Court by filing appropriate application to cancel NBW issued against him and if any such application is filed, the Trial Court is directed to consider the said application on the same day on merits in accordance with law.

With the above directions, this criminal original petition is disposed of.
