The petition in CMP.No.1436 of 2017 has been filed by the petitioners to condone the delay of 936 days to file a petition to set aside the abatement caused due to the death of the first respondent, CMP.No.1437 of 2017 to set aside the abatement and CMP.No.1438 to 2017 to bring on record the legal representatives of the deceased first respondent.

2. The learned counsel for the petitioners submitted that as the date of death of the first respondent came to their knowledge only 06.01.2017, the delay has occurred and the delay is neither willful nor wanton.

3. Considering the submissions made by the learned counsel for the petitioner, these petitions are Ordered.
