Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 09.07.2025 and to create and operate a fresh waiting list under the Economically Weaker Section (EWS) category for the post of Upper Division Clerk for the purpose of filling the two (2) existing unfilled vacancies reserved under the EWS quota in accordance with the Recruitment Notification bearing No A -34012/7/ E1/2022/DP and AR (EXAM) dated 29.09.2022 and Notification No A34012/7/2022/DP&AR (Exam) PF. 3 dated 28.11.2023 and the subsequent Notifications and Memorandums issued by the Respondent. 1/4

ORDER

By consent, the main writ petition itself is taken up for final disposal at the admission stage.

2.Learned counsel for the petitioner would submit that though the petitioner is a qualified candidate under the Economically Weaker Section (EWS) category for the post of Upper Division Clerk for the purpose of filling the two (2) existing unfilled vacancies reserved under the EWS quota in accordance with the Recruitment Notification bearing No A -34012/7/ E1/2022/DP and AR (EXAM) dated 29.09.2022 and Notification No A34012/7/2022/DP&AR (Exam) PF. 3 dated 28.11.2023 and the subsequent Notifications and Memorandums issued by the Respondent, his candidature has not been considered and thereby, the petitioner had sent a representation on 09.07.2025 to the respondent. As the said representation of the petitioner has not been considered, he has approached this Court by way of present writ petition.

3. Heard both sides and perused the materials available on record.

4. When the matter is taken up for hearing, Mr.V.Vasanthakumar, learned Additional Government Pleader(Pondicherry) appearing for the respondent, would submit that the remedy of the petitioner lies before the Administrative Tribunal as per Section 14 of the Administrative Tribunals Act, 1985.

5.In view of the above submission, the writ petition stands dismissed. However, liberty is granted to the petitioner to approach the Administrative Tribunal as per Section 14 of the Administrative Tribunals Act.
