This petition has been filed to direct the 2nd respondent to secure the convict viz., Selvaraj by executing the Warrant in connection with C.C.No.133 of 2017 on the file of the Learned Judicial Magistrate Court No.III, Coimbatore. 2.On the complaint lodged by the petitioner, the 2nd respondent had filed a final report for the offence under Sections 406 and 420 and the same has been taken cognizance of by Judicial Magistrate No.III, Coimbatore in C.C.No.133 of 2017 and the accused were convicted and sentenced with imprisonment. As against the sentence imposed, the accused filed appeal before the IV Additional District and Sessions Judge in Crl.A.No.283/2018 by an order dated 07.12.2018, however the https://hcservices.ecourts.gov.in/hcservices/
suspension of sentence imposed on them was confirmed by the first appellate court.
3.Aggrieved by the same, accused persons preferred a revision before this Court in Crl.R.C.No.64 of 2019 and the same was dismissed by an order dated 26.02.2019. Pursuant to the said dismissal order, the Trial Court in C.C.No.133/2017 issued Non-Bailable Warrant as against the accused.
4.Considering the above facts and circumstances, the 2nd respondent is directed to secure the accused in C.C.No.133 of 2017 within a period of four weeks from the date of receipt of a copy of this order and proceed further, in accordance with law. 5.With the above, this Criminal Original Petition is disposed of.
