O R D E R

(Order of the Court made by S.M.SUBRAMANIAM,J.) The proceedings of the Block Development Officer dated 03.10.2019 is sought to be quashed in the present writ proceedings. 2.

The Block Development Officer is an incompetent Authority to remove the encroachments. However, he is empowered to submit a Report regarding the encroachments to the jurisdictional Tahsildar for the purpose of removing the encroachments by following the procedures. Thus, the impugned order passed by the Block Development Officer, Kattanguluthur Panchayat Union, has been converted as a Report and the 5th respondent/the Page No.2 of 5

Block Development Officer is directed to communicate the same to the jurisdictional Tahsildar, who in turn is directed to remove the encroachments by following the procedures as contemplated under the provisions of the Tamil Nadu Land Encroachment Act, 1905. The said exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
