ORDER

This civil revision petition is directed against the order of the learned Subordinate Judge, Harur, dismissing the application filed by the petitioner herein under Order VIII, Rule 9 of CPC seeking permission of the court below to file additional written statement.

2. Today, when the revision petition is taken up for hearing, the learned counsel for the petitioner as well as the learned counsel for the respondents 1 and 2 have submitted that already the trial of the suit is over and the suit now stands posted for delivery of judgement.

3. Considering the fact that already trial of the suit is over and the suit now stands posted for delivery of judgement, the application seeking permission to file additional written statement cannot be entertained at this length of time. This revision petition fails accordingly.
