This application has been filed to relax the condition imposed on the petitioner in Crl.M.P.No.6870 of 2022 in Crl.A.No.519 of 2022 dated 06.07.2022 to appear before the Trial Court on the first working day of every English Calendar month at 10.30. a.m., until the disposal of the Criminal Appeal and if he is not able to appear before the Trial Court on any day, he shall make arrangements to file an application under Section 317 of Cr.P.C. and shall appear before the Trial Court on any other day in lieu of the date of his absence, as directed by the Trial Court.

2. The learned counsel for the petitioner submitted that the petitioner is complying the above condition, without fail from 01.08.2022 to till date. He further submitted that the petitioner is a resident of State of Assam and he is suffering from Cardiac issue, blood pressure and diabetes and he is taking treatment in the local hospital of State of Assam. Hence, he prayed to relax

the above condition.

3. The learned Government Advocate (Crl. Side) would submit that the petitioner is complying with the conditions regularly.

4. Considering the said submission, the condition imposed as against the petitioner is totally relaxed. However, the petitioner is directed to appear the Trial Court, as and when required.
