This petition has been filed to condone the delay of 3 days in filing the above C.R.P. against the fair and final order dated 03.07.2019 in I.A.No.267 of 2017 in O.S.No.25 of 2011 on the file of the Sub Court, Jayamkondam, Ariyalur.
2. Normally, when a condone delay petition is filed, notice will be ordered to the respondent. Here the delay is only 3 days, for which plausible and acceptable reasons have been given by the petitioner.
3. Therefore, even if notice is served on the respondent, the respondent cannot improve or alter the case. Hence, this Court is of the opinion that issuing the notice to the respondent would be an empty formality. Hence, the delay of 3 days in preferring the above C.R.P. is condoned and the petition is ordered accordingly.
