This miscellaneous petition has been filed to condone the delay of 165 days in filing the writ appeal.

Though, Mr.Sethu Prabhakaran learned Counsel appearing on behalf of the 1st respondent would strenuously oppose for condonation of delay, we are convinced with the reasons stated by the appellant in the accompanying affidavit filed in support of the miscellaneous petition.

3. Therefore, delay is condoned and this miscellaneous petition stands ordered.
