The petitioner, who was arrested and remanded to judicial custody on 22.10.2022 for the alleged offence under Sections 420, 120-B and 408 IPC in Cr.No.185 of 2022, seeks bail.
2.The case of the prosecution is that the petitioner conspired along with four other accused and using A1 who was working under the defacto complainant, borrowed gold jewels in the name of the defacto complainant from his suppliers weighing 15547.884 grams and subsequently the same has been shared among the accused and thereby cheated the defacto complainant. Hence, the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner is arrayed as A5 and has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. anu 4.The learned Government Advocate (Crl.Side) would submit that the petitioner had conspired along with four other accused and cheated the defacto complainant by borrowing gold jewels in his name from his suppliers weighing 15547.884 grams. He would submit that there are totally seven accused in this case, among them, some of the accused have been secured and the other accused are still absconding. Therefore, if the petitioner is released on bail, the proceedings will be stalled. Hence, he vehemently opposed to grant bail to the petitioner. 5.Considering the allegation level against the petitioner and that still other accused are yet to be secured, this court is not inclined to grant bail to the petitioner.
