O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 420 of IPC in Crime No.319 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. Sum and substance of the complaint is that the property of one Chellappan remained undivided among his legal heirs for nearly 50 years. On 17.05.2022 a power of attorney was executed by his legal heirs, by name Kunjappan, his daughter Kanika, Rasammal, Pappathi and Palanisamy in favour of the first petitioner. The said Kunjappan died on 28.06.2022 and thereafter, the power of attorney has become invalid. However, it is alleged that the first petitioner had sold the property based on the invalid power of attorney. Hence, this complaint.

3.The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have no role in the crime. 4.However, the complaint clearly shows that after the death of one of the principal by name, Kunjappan, the property has been alienated based on the power of attorney. It is the matter to be investigated in accordance with law for which custodial interrogation of the petitioners is required.
