Petition filed under Article 226 of The Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider and pass orders on the representation dated 02.02.2017 of the petitioner regarding restoration of Cable TV Operation to the petitioner under Licence LCO No.35864 and to restrain Thiru. R. Gunasekaran from operating cable TV business in the area of the petitioner.

ORDER

The petitioner has come forward with this writ petition praying to issue a Writ of Mandamus directing the respondents to consider and pass orders on the representation dated 02.02.2017 of the petitioner for restoration of Cable TV Operation in his favour under Licence LCO No.35864 and consequently to restrain the third respondent herein from operating cable TV business in the area in which the petitioner operates.

Heard the learned counsel for both sides and perused the material records. The relief sought for by the petitioner in this writ petition no longer survives for consideration. It is evident that the licence issued in favour of the petitioner has been rescinded for non-payment of subscription amount payable to the second respondent for about 18 months. Therefore, as on the date of filing the writ petition, the petitioner is not a licence holder at all. Further, subsequent to the filing of the writ petition, the Cable TV operation in the State has been digitalised and Local Cable TV Operator (LCO) licence is no longer issued. In view of the above, no relief can be granted to the petitioner in this writ petition. 3.

In the light of the above, the writ petition is disposed of. No costs.
